THE STRATEGIES ON THE IMPLEMENTATION OF EFFECTIVE WILLS IN MALAYSIA

Abstract

Wills is one of the highly recommended methods in Islam for managing the estate. The process of claiming an estate will be easier if the deceased leave a wills. However, the actual concept of wills should be understood by the makers, recipients and trustees in order to ensure the management of wills can be implemented smoothly. Implementation and management of wills in Malaysia has various issues and problems arising from the misunderstanding of the community or trustees on the concept and law of wills. As a result, the testament estate has to be frozen because there are illegal and lacking documentation papers. Consequently, this study is focused to study the strategies to resolve the issues and problems, so that the wills management will be more effective. To achieve these objectives, the qualitative research design is applied. Secondary data has been extracted from annual reports, journals and related textbooks. Primary data were obtained through face-to-face interviews that were conducted using semi-structured questions. Primary and secondary data were then collected and analyzed using content analysis methods. The finding shows that there are several strategies that can be implemented for the improvement of management testate estate in Malaysia
